1. General
 
1.1. In these terms and conditions, “we” or “us” means Yew Luck Luck and the "customer" or “you” means any person, firm, company or body which places an order with us. Please read these terms and conditions carefully before using our website. By using our website or any part of it, you agree that you have read these terms and conditions and that you accept and agree to be bound by them.
 
1.2. Prices are subject to change without prior notice and all orders are subject to our acceptance at our sole discretion and stock availability.
 
1.3. All photos and images of the products displayed on our website are for illustration purposes in order to help you recognize the products only. The actual size, dimension and colour of the products may differ.
 
1.4. It is your responsibility to ensure that the products you intend to purchase are sufficient and suitable for your purposes and meet your individual requirements. We do not warrant that the products for sale in our website will meet your individual requirements. You acknowledge that the products purchased by you are standard and not made bespoke to fit any particular requirements that you may have.
 
1.5. If from time to time any products become out of stock, we reserve the right to offer alternative product(s) of similar value and style.
 
1.6. All orders are subject to confirmation of final availability and we reserve the right to reject the order in the event that any of the products or services requested are unavailable.
 
2. Registration
 
2.1. You are required to register as a user before placing any order through our website:
  • You must be 18 years old or above and are capable of entering into a binding contract (in case you are below 18 years old: you must obtain consent from your parent(s) or legal guardian(s), their acceptance of the Terms and Conditions herein and their agreement to take responsibility for (i) your actions and (ii) any charges associated with your purchases at our website.
  • You must provide us with accurate, complete and up to date registration information;
  • You must safeguard your username and password;
  • You authorize us to assume that any person using the website with your username and password is either you or is authorized to act for you;
  • We have the absolute discretion to refuse registration of a potential customer and to terminate the registration of any customer for any reason whatsoever.
 
2.2. Please inform us via WhatsApp to designated phone number immediately of any changes to the information that you provided so that we can communicate with you effectively
 
2.3. In the event that your account is not used for a specified period (currently, 3 years), we will, for your own and our protection, deem your account to be no longer in use, and we will deactivate your account and all your accumulated points and/or e-vouchers will be forfeited (where applicable). You will need to reapply for a new account if you wish to make further purchase at our website.
 
2.4 Prohibited activities:
 
You agree and undertake NOT to use this website for the following:
 
(a) impersonate any person or entity or to falsely state or otherwise misrepresent your affiliation with any person or entity;
 
(b) use the Platform or Services for illegal purposes;
 
(c) attempt to gain unauthorized access to or otherwise interfere or disrupt other computer systems or networks connected to the Platform or Services;
 
(d) post, promote or transmit any unlawful, harassing, threatening, abusive or otherwise objectionable materials through the Platform or Services;
 
(e) interfere with another users of the website;
 
(f) use or upload, in any way, any software or material that contains, or which you have reason to suspect that contains, viruses, damaging components, malicious code or harmful components which may impair or corrupt the Platform’s data or damage or interfere with the operation of another Customer’s computer or mobile device or the Platform or Services; and
 
(g) use the Platform or Services other than in conformance with the acceptable use policies of any connected computer networks, any applicable Internet standards and any other applicable laws.
 
3. Privacy
 
We are committed to safeguarding the privacy of individuals with respect to personal data. We therefore make sure that our policies and practices in relation to the collection, use, retention, transfer and access of personal data comply with the requirements of the Personal Data Protection Act 2012 under the laws of Singapore. 4. Payment
 
4.1. Our website accepts payment by designated credit cards, pay-pal or paynow/paylah via QR code as provided in our website. All product prices listed are in Singapore dollars. The prices listed in our website may differ from the prices of the same products in our physical stores.
 
4.2. We accept Visa, MasterCard and AMEX.
 
4.3. Under Credit Card Purchase Protection service (e.g. Visa Verification Service, MasterCard Secure Code) customers can enjoy safe and secure shopping by using their own credit card with specific password or security code. Credit cards used for shopping should be valid and under the purchaser’s own name.
 
4.4. Acceptance of orders is subject to our sole discretion. A final electronic receipt will be issued to you via email and/or our website.
 
4.5. Gift Vouchers: Yew Luck Luck Gift Vouchers are not redeemable at our website.
 
4.6. e-Vouchers and e-Coupons (if applicable): only designated e-Vouchers and e-Coupons accepted by us can be redeemed at our website subject to the terms and conditions of each respective e-Voucher / e-Coupon (as the case may be).
 
4.7. Where there are additional charges for delivery, such charges will be set out separately for your acknowledgement and confirmation prior to proceeding to payment.
 
4.8. Minimum purchase amount at our website is $5 (exclude delivery charges)
 
5. Delivery
 
5.1. Basis of supply: we only serve and deliver products to end consumers. We are not selling our products for re-sell purpose. If we have grounds to believe that you are not purchasing our products as an end user, we reserve the right to decline or cancel your order.
 
5.2. We accept orders for delivery to the specified delivery address in Singapore, or collection at our store located in Singapore
 
5.3. In case where the deliveries are delayed due to factors beyond our control (as mentioned under force majeure terms), we will try our best to arrange the products to be delivered on the next business day.
 
5.4. If you fail to receive your purchased products upon the first delivery appointment(s) or you give us inaccurate information on your address, you need to contact us via whatsapps to arrange another delivery appointment within 7 days. We reserve the right to (i) charge you an additional delivery fee for subsequent delivery(es); or (ii) arrange your ordered goods to be collected by you at our store.
 
5.5. All expected delivery dates and time are estimates only. We shall not be liable for any loss or damage incurred or suffered by the customer as a result of any late delivery.
 
5.6. In case of any dispute, our determination shall be final.
 
5.7. Force majeure: We shall not be liable for any delay or failure to perform caused by or resulting from acts of God, fire, flood, accident, riot, war, government intervention, embargoes, strikes, labour difficulties, equipment failures, or any other causes beyond our control.
 
6. Self-Collection
 
6.1. The ordered goods will be available for collection at the designated physical store within 3 business days. You will be notified by us via SMS or email when your ordered goods are available for collection.
 
6.2. Please collect your purchased item(s) at your selected physical store within 7 days from the designated date of collection during the specified business hours of the selected physical store.
 
6.3. When you pick up the product in our physical store, you or your authorised representative (who must be 18 years old or above) will be required to produce your email or SMS notification for identity verification. We may need you to provide further information or document(s) to verify your identity (such as your full name or other personal information under your account profile) and the identity of your authorised representative. If we are not satisfied that the person requesting to collect your order(s) is yourself or your authorised representative, we will refuse the collection of the order(s) in order to safeguard your interest.
 
7. Exchange and refund
 
7.1. You are required to examine the goods upon collection for any deficiencies and/or damages. If any product is found to be expired, missing, incorrect or damaged inside after receiving the delivery or collection at our designated physical store, claims for return (if any) must be lodged to us by email or whatsapps within the same days from the date of delivery or the same day for self-collection; otherwise we shall have the discretion to refuse your claims. All requests for refund will be reviewed on case-by-case basis and subjected to the company’s approval.
 
7.2. Return of products can be arranged for the following reasons:
  • If the product is expired / incorrect/ damaged, in its original packaging upon delivered.
  • If the product is expired / incorrect/ damaged, in its original packaging upon collection at the store.
    In such case, you are required to return the products with the original packaging to us.
 
7.3. We reserve the rights to reject any exchange or refund for opened or used product. We shall not be liable to you for any losses, liabilities, costs, damages, charges or expenses as a result.
 
7.4. Medicine, hygiene-sensitive products sold are non-refundable.
 
7.5. Original sales receipt or relevant electronic receipt must be produced to us for request of a product exchange and/or refund.
 
7.6. All gift items must be returned together with the returned products. Otherwise the retail value of the gift item will be deducted from the refund.
 
8. Cancellation
 
8.1. We may cancel an order if the product is not available for any reason or any other reasons which caused an order not able to be fulfilled. We will notify you if this is the case.
 
8.2. You are not allowed to cancel the order once the goods already pick up from our store/warehouse.
 
8.4. For any ordered goods remain undelivered (for delivery to your designated delivery address) or uncollected (for collection at designated physical store), we shall have the right to cancel your order at our own discretion and refund the relevant payment to you without further notice to you.
 
9. Others
 
9.1. Title to the product shall remain vested in us until we receive full payment of the price, and title and risk shall pass to the customer upon collection of the product(s) by our delivery team or by the customer.
 
9.2. We shall under no circumstances be liable for any loss (whether direct or indirect) of revenue, loss of profits or any indirect or consequential loss whatsoever suffered, sustained or incurred by you or by other person arising (directly or indirectly) out of the sale and purchase transaction with you.
